Das Bezirksamt Lichtenberg hat Hinweise auf Umbauten ignoriert, die ein neues Lärmgutachten für das Bauprojekt „Kaisergärten“ notwendig machen. Dadurch hat das Bezirksamt die Rechtmäßigkeit des Bebauungsplanes gefährdet.
Auf dem Grundstück entlang der Bahntrasse im historischen Prinzenviertel in Karlshorst wird ein Bauprojekt geplant – die „Kaisergärten“, auch bekannt als „Prora von Karlshorst“. Zur Berücksichtigung der Lärmimmissionen ausgehend von der benachbarten Bahntrasse und der Abstellanlage der Deutschen Bahn wurde ein Gutachten erstellt. Nach der Erstellung des Gutachtens wurden die Bahntrasse und die Abstellanlage baulich und nutzungsseitig verändert.
Auf die Kleine Anfrage der AfD-Fraktion antwortete das Bezirksamt lakonisch. „Die Überwachung und Genehmigung von Abstellanlagen und Bahntrassen obliegt nicht dem Bezirksamt Lichtenberg. Diese sind bei der Deutschen Bahn selbst zu erfragen.“
Seiner Verantwortung wird das Bezirksamt damit nicht gerecht. Wenn die Deutsche Bahn ihre Abstellanlage umbaute, nachdem der Gutachter die Anlage bewertete, sind die im Gutachten ermittelten Werte nicht mehr richtig. Der Bebauungsplan würde infolge dessen auf Grundlage eines nicht zutreffend ermittelten Sachverhaltes beschlossen.
Dies ist die Antwort des Bezirksamts zur Kleinen Anfrage (KA/0491/VIII):
Das Bezirksamt bittet die BVV um folgende Kenntnisnahme:
Wann wurde das Gutachten erstellt (bitte die zeitliche Reihenfolge von Gutachten / Veränderungen an der Bahntrasse darstellen)?
Zu 1. Zum Bebauungsplan 11-57a wurde vom Stadtentwicklungsamt eine schalltechnische Untersuchung in Auftrag gegeben. Das Gutachten wurde am 31.01.2018 erstellt, berücksichtigt unter anderem das Vorhaben „Ausbau Werk Rummelsburg BRGBT“ und bezieht sich auf die im Rahmen des im September 2017 eröffneten Planfeststellungsverfahrens durchgeführten schalltechnischen Untersuchungen. Zudem wurde die Abstellanlage Karlshorst und alles weitere Gewerbe berücksichtigt.
2. Welche baulichen Veränderungen sind seitdem an der Abstellanlage und der Bahntrasse geschehen?
Zu 2. Es liegen vier Abstellgleise vor. Von einer wesentlich veränderten Lärmimmission der Eisenbahn im B-Plan-Verfahren ist dem Bezirksamt Lichtenberg nichts bekannt. Von der DB Fernverkehr wird bestätigt, dass die für das B-Planverfahren zu Grunde liegende schalltechnische Betrachtung nach wie vor aktuell ist. Die Überwachung und Genehmigung von Abstellanlagen und Bahntrassen obliegt nicht dem Bezirksamt Lichtenberg. Diese sind bei der Deutschen Bahn selbst zu erfragen.
3. Wie wirken sich die baulichen Veränderungen auf die Lärmimmissionen auf das Baugrundstück aus, insbesondere die Lärmschutzwand auf der östlichen Trassenseite, das zusätzliche Gleis und die neue Stützmauer?
Zu 3. Die Auswirkungen wurden in mehreren Gutachten geprüft.
4. Wird ein weiteres Gutachten erstellt, das die Veränderungen berücksichtigt? Falls nicht: Warum nicht?
Zu 4. Nein, die Veränderungen wurden bereits im Gutachten berücksichtigt (siehe Antwort 1).
